Every bid you submit is a promise about prices you do not control yet. In a stable market that is a manageable risk. In 2026 it is the single fastest way to hand back your margin.


Consider what steel has done this year. The Bureau of Labor Statistics Producer Price Index for steel mill products sat at 291.6 in November 2025. By July 2026 it had reached 374.2. That is a 28 percent increase in eight months, including a 12.9 percent climb between March and July alone, and a 22.5 percent rise year over year. If you bid a structural steel package in the spring at winter prices and bought it in the summer, that gap came directly out of your job.

What Changed in 2026

Two things happened this year that made old bidding habits expensive.


First, the Section 232 metal tariffs were significantly restructured. A proclamation published in the Federal Register on April 9, 2026 set tariffs on aluminum, steel, and certain copper articles at 50 percent ad valorem, effective for goods entered for consumption on or after 12:01 a.m. on April 6, 2026 (full text). Certain copper articles and certain derivative articles were generally set at 25 percent, with a reduced 10 percent rate for derivative articles whose metal content was entirely melted and poured, or smelted and cast, in the United States.


The structural change matters more than the headline rate. The tariffs now apply to the full customs value of the imported product, regardless of metal content. Previously, duty was calculated only on the metal portion of a derivative product. A fabricated assembly that is partly steel is now dutied on its entire value, not just the steel in it.


Second, the regime was extended and locked in. A further proclamation published June 4, 2026 (full text) set the applicable rates for goods entered on or after 12:01 a.m. on June 8, 2026 through 11:59 p.m. on December 31, 2027. In other words, this is not a two-month disruption to wait out. It is the pricing environment for the next several bidding seasons. And the list is still growing; the Commerce Department requested public comment in August 2026 on applying duties to additional derivative products.


The market has noticed. FMI's Civil Infrastructure Construction Index put its materials cost component at 25.0 in the second quarter of 2026, down sharply from 35.4 in the first quarter, with 71 percent of firms reporting increased competition and 36 percent reporting declining bid prices (full report). Rising input costs and falling bid prices at the same time is a margin vise.


Which Materials Actually Move the Needle in Heavy Civil

Steel makes the headlines, but it is worth being precise about where metal actually shows up on a heavy civil job, because it is more places than people assume. Reinforcing steel goes into every structure you pour: box culverts, headwalls, retaining walls, bridge decks, and abutments. Beyond rebar there is structural steel for bridge girders and beams, sheet piling and H-piling for shoring and foundations, corrugated metal pipe and steel casing on utility work, plus guardrail, sign structures, and manhole and inlet castings. On a bridge or a major drainage package, steel is frequently the single largest material line on the estimate.


That said, steel is not the only exposure, and on a dirt-and-paving job it may not even be the biggest. The clearest evidence of what the industry actually considers volatile comes from the agencies themselves. New York State DOT Standard Specifications Section 698, Price Adjustments, sets out formulas for compensating the contractor, or the agency, for "increases or decreases in the price of asphalt, fuel, or steel/iron throughout the life of the contract." Those three materials, asphalt, fuel, and steel, are the ones a major state DOT has formalized.


Connecticut DOT takes a similar approach with a dedicated Steel Cost Adjustment item, described in its cost estimating guidelines as a contract item "intended to ensure that payment for structural and reinforcing steel materials reflect the current market price at the time the order is placed," limited to multi-year projects with significant steel quantities (CTDOT).


So the practical scope for most heavy civil contractors is roughly this: steel and iron (rebar, structural, piling, pipe, and castings), liquid asphalt and asphalt mixtures on paving work, diesel fuel on anything earthwork-heavy, and cement and concrete on structures. Everything in this article applies to all of them. Steel simply happens to be the clearest current example, because the tariff situation has made its movement both large and well documented.


If you self-perform mostly dirt and paving, read every mention of steel below as fuel and liquid asphalt instead. The mechanics of an escalation clause do not change with the commodity.


Why Fixed Prices Break in a Market Like This

The mechanics are simple and unforgiving. On a typical heavy civil job there is a gap of weeks or months between the day you commit to a number and the day you actually buy the material. Your supplier quote has an expiration date. Your bid does not.


Say you carry 400 tons of structural steel on a bid submitted in March 2026, priced from a quote good for 30 days. The award takes six weeks. Submittals and fabrication push delivery to July. Using the BLS steel mill products index, the underlying price level rose 12.9 percent over that window. On a 400 ton package that is not a rounding error, it is most of a job's profit.


The instinct is to pad the number. That works right up until the bid opening, where bidding into a competitive market with a contingency your competitors did not carry means you simply do not win the work. Padding converts a margin problem into a hit rate problem. An escalation clause solves it differently: instead of pricing the risk, you allocate it.


What an Escalation Clause Actually Does

A price escalation clause is contract language that adjusts the contract price when the cost of a specified material moves beyond an agreed threshold, measured against an objective index, between a defined baseline date and the date of purchase.


The important word is objective. A good clause does not ask the owner to trust your invoices or your judgment. It ties the adjustment to a published number that neither party controls, so the conversation at the end is arithmetic rather than argument.


ConsensusDocs 200.1, the Time and Price Impacted Materials Amendment, is the most widely recognized standard form of this language and is worth reading even if you end up negotiating your own. Standard contract families from AIA Contract Documents and guidance from the Associated General Contractors of America are useful reference points as well.


On public work, check the agency's standard specifications before drafting anything. As noted above, many state departments of transportation already maintain their own price adjustment provisions, and NYSDOT Section 698 is a good model for what an agency-side formula looks like in practice. Federal-aid projects operate under FHWA contract administration requirements. If a mechanism already exists in the specs, use it rather than drafting your own, and make sure your estimators know it is there. Adjustment provisions that nobody claims are surprisingly common.


The Five Parts of a Clause Owners Will Accept

Owners reject escalation language when it reads like a blank check. Clauses that get signed tend to share five features.


  1. A named material and a named index. Not "materials generally." Specify structural steel, or reinforcing bar, or ductile iron pipe, and name the exact published index series you will measure it against.

  2. A baseline date and a trigger threshold. The baseline is usually the bid date. The threshold is the movement you absorb before the clause activates, commonly somewhere in the 5 to 10 percent range. Below the threshold, the risk is yours.

  3. A stated adjustment mechanism. Spell out that the contract price adjusts by the verified quantity multiplied by the indexed price difference above the threshold. Show the formula in the clause.

  4. Symmetry. This is the provision that gets clauses approved. If the index falls, the owner gets the savings. A de-escalation provision reframes the clause as shared risk management rather than one-way protection, and it costs you very little in a rising market.

  5. A documentation requirement and a cap. Commit to providing purchase records, and consider offering a ceiling on total adjustment. A capped clause is far easier for a public owner to defend internally than an open one.


Choosing the Right Index

The index you name determines whether the clause protects you or merely feels like it does. Three rules.


  • Match the index to the actual commodity. Steel mill products, reinforcing bar, and fabricated structural steel do not move together. The BLS Producer Price Index publishes separate series at a useful level of detail, and series WPU1017 for steel mill products is a common reference point for civil work.

  • Match the measurement dates to your actual exposure. The relevant window is bid date to purchase date, not bid date to notice to proceed. If your clause measures the wrong interval, it will under-compensate you exactly when it matters.

  • Use a published series, not a supplier's price list. Owners will not accept a benchmark controlled by one of the parties, and reasonably so. Published government data is neutral ground.


One caution worth stating plainly: an index measures the market, not your invoice. If your particular supplier raises prices more than the index does, the clause will not make you whole. That gap is the price of using an objective benchmark, and it is usually worth paying.


When the Owner Says No: Five Fallbacks

Plenty of owners, especially on hard bid public work, will not entertain escalation language at all. That does not leave you without options.


  1. Shorten your bid validity period. If you must hold a fixed price, hold it for less time. This is the single most underused lever in heavy civil bidding.

  2. Buy early and store. Procuring critical material at bid time converts a price risk into a storage and cash flow cost, which is usually the cheaper of the two. Confirm the contract permits payment for stored materials.
